California has always been one of the most challenging states in the country for employers. With a myriad of new laws and case developments, 2022 looks to be an even more complicated labyrinth for employment law compliance. During our annual Legal Update, Partners Maria Stearns and Brandon Sylvia of Rutan & Tucker, LLP and Partners Nicole Kamm and Hannah Sweiss of Fisher & Phillips LLP will:
  • Summarize new employment laws for 2022;
  • Discuss significant cases from 2021 and their anticipated impact on employers in 2022; and
  • Conduct targeted break-out sessions on the top compliance risks and challenges for 2022 and ways to proactively manage them.
Attendees will: learn about the new and evolving laws and regulations governing workplaces and compliant practices, and gain insight into identifying potential problem areas for further analysis and risk mitigation.   Our Presenters: Maria Stearns Partner Employment Chair Rutan & Tucker, LLP Maria Stearns represents local and national employers doing business in California. They seek her counsel on employment litigation and transactional matters, with particular expertise in healthcare, restaurant, manufacturing and apparel industries. Maria’s creative strategies in efficiently and effectively resolving matters have been recognized by the Daily Journal in its inclusion of Maria in the prestigious list of California’s ‘Top Women Lawyers’ and ‘Top Employment Lawyers’.   Brandon Sylvia Partner Employment Rutan & Tucker, LLP Brandon Sylvia’s practice involves representing and counseling employers in all areas of employment law, including harassment, workplace discrimination, terminations, employment agreements, leaves of absence, wage and hour issues, trade secrets, unfair competition, accommodating disabilities, and employment policies and procedures. Brandon has represented employers in various civil litigation matters – including appellate proceeding before the California Court of Appeal, the California Supreme Court, and the Ninth Circuit Court of Appeals – and before state administrative agencies. He graduation second in his class at Chapman University School of Law, and was selected by the faculty as the Distinguished Graduate of the 2008 Class. While at Chapman, was a member of the Chapman Moot Court Honor Board, and served as the Editor-In-Chief of the Chapman Law Review for 2007-2008.   Nicole Kamm Partner Fisher & Phillips LLP Nicole Kamm represents a broad range of clients, from small businesses to national companies, in a variety of industries, including healthcare, technology, manufacturing, retail, hospitality, construction, transportation and professional services. Nicole defends employers and provides dispute resolution counsel against individual and class claims of discrimination, harassment, retaliation, wrongful termination, and wage and hour violations before state and federal courts and administrative agencies. Nicole also provides strategic counsel and management training on employment issues that arise in the workplace, including hiring, discipline and termination decisions, leaves of absence, reductions in force and compliance issues arising under Title VII, the California Fair Employment and Housing Act, the California Family Rights Act, the Americans with Disabilities Act, the Fair Labor Standards Act, the California Labor Code and Industrial Welfare Commission wage orders, and the federal and California Worker Adjustment and Retraining Notification Act. Nicole has handled a full range of labor and employment matters, including claims before the Department of Labor, EDD, EEOC, and California Division of Labor Standards Enforcement (DLSE). Nicole regularly advises employers on preventive steps to minimize potential exposure arising from issues such as wage and hour compliance, independent contractor classification, and mass lay off strategies. Nicole is active in the local business and legal community. She previously served on the San Fernando Valley Bar Association’s Board of Trustees and is the co-founder of Women to Women (W2W), a networking group for dynamic and innovative female professionals. Super Lawyers designated Kamm a “2019 Top Female Attorney” in Los Angeles Magazine and she was named a “Top Attorney” by Pasadena Magazine. She received her J.D., cum laude, from Pepperdine School of Law and her B.A. from University of California, Berkeley.   Hannah Sweiss Associate Fisher & Phillips LLP Hannah Sweiss represents a broad range of clients, from small businesses to national companies, in a variety of industries including trucking, hospitality, travel, manufacturing, and healthcare. Hannah’s practice is focused on representing and defending employers in class action wage and hour lawsuits as well as representative lawsuits brought under California’s Private Attorneys General Act (PAGA). Hannah has been lead counsel on numerous complex wage and hour/PAGA lawsuits achieving great results in cases with less than twenty members to cases with thousands of members. Hannah has also handled a full range of Labor and Employment matters, from single plaintiff to multi-plaintiff actions with claims including, harassment, discrimination, retaliation and wrongful termination. Hannah has unique experience with individual matters and audits before the Employment Development Department (EDD), Department of Labor (DOL) and California Division of Labor Standards Enforcement (DLSE). Additionally, Hannah advises employers on preventative measures to litigation arising from various issues including wage and hour compliance, workplace safety, employee classification, independent contractor classification, mass layoff strategy, and management training. Hannah was recognized by Super Lawyers as a Rising Star from 2016-2019 and in 2021. She has also been named Best Lawyers: Ones to Watch (2021). Hannah is active in the legal community at the local and national level. She is the President-elect of the Arab American Lawyers Association of Southern California and is a founding steering committee member of the National Arab American Bar Association in Washington D.C. Hannah also serves on the Board of the Los Angeles Chapter of the National Human Resources Association and is one of five of the organization’s Diversity, Equity and Inclusion Council members. Hannah has presented on a variety of Labor and Employment topics, including legal updates, various COVID-19 topics, elimination of bias, anti-harassment and many other Employment Law areas. She has also authored and published several subject-matter articles, blogs and legal alerts.
