This 3-hour program will cover recent legal updates pertinent to HR professionals.

Session 1 (1 hour) – Recreational Marijuana in the Workplace. This informative discussion on the recent legalization of recreational marijuana in Missouri and other jurisdictions will help clear the air and provide you with legal and practical guidance going forward on this journey into the new – but relaxed – world we find ourselves in. Presented by Tim Bubenik.

Session 2 (1 hour) – Non-competition Agreements, Reductions in Force, and Other Important Issues in an Uncertain Economy. Employers often are forced to make difficult decisions when the economy slows down, resulting in unhappy employees and the potential for litigation. During this session, we will discuss recent developments in this area of employment law and give helpful advice on how to approach these opportunities. Presented by Michael Powers.

Session 3 (1 hour) – The Latest and Greatest in Labor and Employment Law. Courts, legislatures, and agencies at both the state and federal level have been active in the labor and employment arena. Information will be provided on this activity to help members stay ahead of the curve. Presented by Stephen Maule.

Presenter Bios:

Timothy Bubenik represents the interest of management in all areas of labor and employment law.  Before joining McMahon Berger, Tim spent six years with the US Department of Labor where he gained extensive experience in the areas of employment discrimination, affirmative action programs, occupational safety and health, and wage and hour issues.  He also actively participated in union activities by representing others during the bargaining and grievance processes.
 
Tim’s employment practice includes all facets of employment law, including employment discrimination claims under Title VII and the Missouri Commission on Human Rights, the Americans with Disabilities Act, and the Family and Medical Leave Act. He is involved in litigating employment discrimination claims as well as investigating and responding on behalf of management to employee claims before administrative agencies. Tim also represents management before the National Labor Relations Board in unfair labor practice charges, challenges to elections and post-election conduct. In addition, he advises clients on employment-related matters such as employment contracts and daily human resources issues.

Michael S. Powers represents the interests of management in all facets of Labor & Employment Law.  Prior to joining McMahon Berger, Michael practiced at a prestigious defense litigation firm in Kansas City, Missouri.  In that practice he represented doctors and hospitals in medical malpractice actions, as well as practicing all aspects of general business litigation.  Prior to entering private practice, Michael served for two years as the Chief Law Clerk in the Missouri 16th Judicial Circuit for the honorable Charles E. Atwell.  Mr. Powers is licensed to practice in Missouri and Kansas.
 
Michael’s practice involves all aspects of employment and labor law, with a focus on employment litigation.  This includes litigating claims of discrimination under the Missouri Human Rights Act, Title VII, the Americans with Disabilities Act and the Family and Medical Leave Act.  He is involved in litigating employment discrimination claims as well as investigating and responding on behalf of management to employee claims before administrative agencies.   Michael also advises clients on employment-related matters including employment contracts and daily human resources issues.

Stephen B. Maule practices in all areas of labor and employment law, including litigation, client counseling, and document preparation and review. Stephen relies extensively on his legal education and his experience with the firm in serving McMahon Berger’s clients. Stephen handles all facets of employment law, including employment discrimination claims under Title VII, ADA, ADEA, FLSA, FMLA, and the Missouri Human Rights Act. He is involved in all aspects of litigating discrimination claims as well as investigating and responding on behalf of management to employee claims before Federal and State administrative agencies. He has appeared in Federal and State courts and administrative agencies throughout the country. In addition, he advises clients on employment-related matters such as personnel policies, daily human resources issues, employment contracts, severance agreements and employee handbooks.

Stephen provides various services to clients in the labor area, including representing management in arbitration, National Labor Relations Board elections, objections to elections including pre and post-election conduct, collective bargaining, strikes and injunctions, and unfair labor practice charges.

Stephen also has extensive experience handling issues before the Office of Federal Contract Compliance Programs, including preparing Affirmative Action Plans, assisting clients in responding to Compliance Reviews, and ensuring compliance with the applicable Executive Order and Regulations. Stephen further provides counsel to clients on immigration matters and assists in the preparation and filing of various immigration petitions with U.S. Citizenship and Immigration Services (USCIS) on behalf of employers, including H-1B, TN, L, and permanent residency. Stephen also has experience representing employers in investigations conducted by U.S. Immigration and Customs Enforcement (ICE).
